Andy,
Joomla is unable to overwrite some php files.
The most probable cause is that you manually modified them and uploaded back to the server through ftp with a different user or wrong permissions.
So check the ownership and permissions of the following files
/libraries/foxcontact/action/base.php
/libraries/foxcontact/design/base.php
and set them to 666 if unsure.
When done retry the update.

I get the error quoted whenever I try to create a new form. I am running Joomla 3.9.5 and Fox Contact v3.8.2. Existing forms seem to work fine, but I am now unable to create a new form.

As my licence is still valid, I would appreciate a link to allow me to download the latest version. I renewed in July 2018.
